Terms of Service
Last updated: [DATE — to be set on first production deploy]
1. Eligibility
You must be at least 18 years old to create an account or use Dragon Den. By creating an account, you represent and warrant that you are at least 18 years of age. If we learn that an account has been created by someone under 18, we will terminate the account.
2. About the Platform
Dragon Den ("Platform", "we", "us") is an event ticketing platform that facilitates transactions between event organizers and ticket purchasers. We are not the ticket issuer, event operator, or organizer. The organizer is the merchant of record for all ticket sales and is solely responsible for the event, including its production, cancellation, and any refunds.
3. Ticket Purchases
When you purchase a ticket, your transaction is with the event organizer, not Dragon Den. The price displayed is the total price — no additional fees are charged by the platform. Payment processing is handled by Stripe on behalf of the organizer.
Available payment methods depend on what the organizer has enabled for the event and may include credit/debit card (with Apple Pay and Google Pay where supported), Cash App Pay, or stablecoin payments via crypto.stripe.com. Each method is processed by Stripe or one of its sub-processors and may carry its own terms — for example, stablecoin payments require connecting a compatible crypto wallet. Cash App Pay and stablecoin payments are available only on events whose organizer's Stripe account is based in the United States, per Stripe's availability requirements for those methods; these methods will not appear in checkout for events outside the United States even if otherwise enabled by the organizer.
4. Refunds & Cancellations
All ticket sales are final — a refund is not available if you can no longer attend. If an event is cancelled, the organizer is responsible for issuing refunds to ticket holders through their payment processor. Contact the organizer directly for refund requests.
5. Ticket Transfers
Tickets may be transferred to any person via email address, subject to the organizer's transfer policy for each event. Some events or ticket types may have transfers disabled. Recipients who do not have a platform account will receive an email invitation to create one and claim their ticket.
Buy-now-pay-later methods (such as Klarna, Affirm, and Afterpay) are not supported on this platform.
6. Age Restrictions
Some events may have age restrictions set by the organizer (e.g., 21+). Age verification at the event venue is the sole responsibility of the organizer and/or venue operator. The platform does not verify attendee age and disclaims liability for age-related admission decisions.
7. Attendee Data & Organizer/Staff Access
When you purchase a ticket, your display name and email address are provided to the event organizer to fulfill your order. See our Privacy Policy for details on what is shared and how. The organizer's use of your information is governed by their own privacy practices, not ours. Dragon Den is not responsible for how organizers use, store, or share attendee data.
Organizers may delegate specific event operations to staff members they add to the event, with access scoped by per-event permission flags they explicitly grant: scanning QR codes at check-in, recording cash/card door sales, and managing the complimentary guest list. Guest-list staff see display names only (email withheld). These permissions are revocable at any time by the organizer. Staff access is subject to the same prohibitions on misuse as organizer access.
When you follow an organizer, your display name and profile photo are shown to that organizer in their followers list, and they may follow you back. Your email address is not shared with the organizer, and there is no follower export — following is a relationship inside the platform, not a mailing list. The platform does not send bulk follower communications on organizers' behalf and does not disclose follower email addresses to organizers; organizers reach followers through on-platform channels (their event feed and notifications). Unfollowing removes you from the organizer's followers list.
Organizers (and their delegated staff) who misuse attendee or follower data (including unsolicited marketing, selling, or sharing with third parties) may have their platform access revoked at Dragon Den's discretion.
8. User Content
By uploading content to Dragon Den (including event descriptions, images, profile photos, and bios), you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with operating the platform. You retain ownership of your content. You represent that you have the right to upload any content you submit.
9. Prohibited Conduct
You may not: use the platform for any unlawful purpose; create fraudulent events or ticket listings; upload or display obscene, pornographic, sexually explicit, or illegal content; upload content depicting minors in any inappropriate context; post hate speech, threats, harassment, or content that promotes violence; upload content that infringes the rights of others; use bots or automated tools to purchase tickets or create accounts; scrape, crawl, or harvest data from the platform; impersonate another person or entity; interfere with the platform's operation or security; or circumvent any access restrictions or security measures. Dragon Den may remove content and terminate accounts that violate these rules without prior notice.
10. Copyright (DMCA)
If you believe content on Dragon Den infringes your copyright, you may submit a takedown notice to our designated agent. [ATTORNEY TO DRAFT: DMCA designated agent contact information, takedown procedure, counter-notice process. Note: designated agent must be registered with the U.S. Copyright Office.]
11. Additional Terms for Event Organizers
If you use Dragon Den as an event organizer, the following additional terms apply:
- You are the merchant of record for all ticket sales. Dragon Den facilitates the transaction but is not the seller.
- You are solely responsible for your event — its production, accuracy of descriptions, legal compliance, and attendee safety.
- You are responsible for setting and honoring your refund policy, and for issuing refunds directly through your payment processor.
- Attendee data (display name, email) provided to you through the platform may only be used for communications related to your events. Selling, sharing with third parties, or using attendee data for unrelated marketing is prohibited and grounds for account termination.
- You are responsible for your own tax obligations related to ticket sales and payouts.
- You grant Dragon Den the right to display your event information, including title, description, images, and venue details, on the platform and in promotional materials.
12. Disclaimer of Warranties
Dragon Den is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or secure. We do not guarantee that any event will take place, will be as described, or will meet your expectations.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Dragon Den disclaims all liability arising from your use of the platform, including liability for the quality, safety, or legality of events listed on the platform, the accuracy of event descriptions, or the ability of organizers to fulfill their obligations. [ATTORNEY TO DRAFT: liability cap, damage exclusions, and carve-outs appropriate for a no-fee facilitator platform under NY law.]
14. Indemnification
You agree to indemnify and hold harmless Dragon Den, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from: your use of the platform, your violation of these Terms, your event (if you are an organizer), or your infringement of any third-party rights. [ATTORNEY TO REVIEW.]
15. Dispute Resolution
[ATTORNEY TO DRAFT: Arbitration clause, class action waiver with 30-day opt-out, small claims court carve-out, NY venue. Note: NY GBL § 399-c limits mandatory arbitration for claims under $5,000.]
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
17. General Provisions
- Electronic communications. By creating an account, you consent to receiving electronic communications from us (transactional emails, account notices). These satisfy any legal requirement for written communication.
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dragon Den.
- Severability. If any provision is found unenforceable, the remaining provisions continue in full effect.
- Waiver. Our failure to enforce any right or provision does not waive that right or provision.
- Assignment. You may not assign your rights under these Terms. Dragon Den may assign its rights without restriction.
- Force majeure. Dragon Den is not liable for failures or delays caused by circumstances beyond our reasonable control (natural disasters, pandemics, infrastructure failures, acts of government).
- Platform modifications. We reserve the right to modify, suspend, or discontinue any part of the platform at any time without liability.
18. Changes to These Terms
We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms. We will notify users of material changes via email.
